Wolfram Research Screensavers and Wallpapers

This end user license agreement (the "Terms of Use") is a legal agreement between you ("you/user") and Wolfram Research, Inc. ("WRI"). By downloading Screensavers and Wallpapers ("Content") from WRI, you hereby agree to be bound by these Terms of Use.

License, Non-Commercial Use

WRI grants to you a limited, revocable, nonexclusive license to download this copyrighted Content for your personal and non-commercial use.

You may not copy, modify, display, license, distribute, transmit, re-post, or download any Content for commercial use without WRI's written consent.

Intellectual Property

You acknowledge that WRI and/or third party affiliates own all rights, title, and interest in all materials associated with WRI Content including, without limitation, all Intellectual Property Rights. You agree not to modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble, or otherwise attempt to derive source code from any WRI Content.

You agree not to remove, obscure, or alter WRI's or any third party's copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the WRI Content, Websites, or other Services.

Disclaimer of Warranties and Limited Damages

WRI does not warrant that the Content is free from all errors and/or omissions and in fact it may contain them. The Content is provided "as is".

WRI does not recommend the use of the Content for applications in which errors and/or omissions could threaten life, injury, or significant loss. Some states do not allow the exclusion of implied warranties, so this may not apply to you. This warranty gives you specific legal rights.

In no event shall WRI, its agents, representatives, and independent contractors be liable for any lost profits, lost use, lost benefits, or any consequential, indirect, incidental, special, or punitive damages, whether in contract, tort, or otherwise, even if WRI has been advised of the possibility of such damages.

You may also have other rights which vary from state to state. This agreement is governed by the laws of the State of Illinois without effect to any choice of law provisions.

Enforceability

If, for any reason, a court of competent jurisdiction finds any provision or portion of these Terms of Use to be unenforceable, the remainder of these Terms of Use will continue in full force and effect.

Waiver

Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by WRI.
